The Supreme Court on Wednesday issued a notice regarding the admissions in Medical Colleges as the private colleges, deemed universities and their association and are not following the proper procedure of the counselling that is being conducted for the admissions of the undergraduates and its a kind of disobedience to the verdict of the court. The notice was issued by the supreme court judge Justice Anil R. Dave, Justice A.K.Sikri, Justice R.K.Agrawal, Justice Adarsh Kumar Goel and Justice R. Banumathi. It is said that the SC Orders Status Quo will be applicable to both the centralised counselling by the state government and the private medical colleges and dental institutes.
Additional Solicitor General P.S.Patwalia says it shows the disrespect of SC’s orders by repeating the same things again and again, although senior counsel Kapil Sibal made a remark by supporting the private college that the private colleges have full right to organise their own counselling sessions. To keep weight in his point kapil sibal also mentioned that after the counselling by the state govt if the students get admission in the private college which he cant afford to go as there is different fee structure for every private college.Justice Sikri before issuing the notice said that he had noted the points mentioned by Kapil sibal. In this regard P.S Patwalia said that Kapil cannot challenge the regulation and statute in contempt of plea.
Wherein Madhya Pradesh government in its petition against the private medical colleges said that the state government has not violated any fundamental right and is solely in the interest of public. Also they mentioned that the private dental and medical colleges has conducted their own counselling which was not in accordance with the state government. Also the counselling is done on the basis of the merit of NEET that is National Eligibility Entrance test added the state government.
